Club Regulations

These regulations are intended to regulate the rules by which the New Balance Customer Club is run, which is managed by Silon Sports Marketing Ltd., the official importer, marketer and distributor of New Balance in Israel. It is recommended to re-read the provisions of these regulations from time to time, as their terms may change from time to time.


1.    Definitions
1.1    "Website" - https://www.newbalance.co.il.
1.2    "Club Member" - Any individual who has filled out a club membership and registration form has met all the club's terms and conditions in accordance with these regulations, and whose membership in the club has been approved by the company. Customers who have previously registered at the chain's stores automatically become club members and will be assigned a membership level (as defined below) based on past purchases made during the last 12 months prior to the launch of the club.


2.    Joining and Membership of the Club
2.1    Any person who registers on the website and has reached the age of 18 may join the club. Membership applies to both new and existing customers, with membership in the club being effective from the date of joining and without any time limit, unless otherwise decided by the company or until the club member notifies that he wishes to terminate his membership, if he has followed the process required to terminate membership in accordance with the provisions of these regulations. If you are not interested in joining the customer club and/or wish to be removed from our customer club at any time, you may act as stated in section 6.1 below.
2.2    Registration for the club is conditional on filling out a registration form that includes the details detailed below: full name, telephone number, email address, date of birth. Creating a user account and membership in the club are also subject to the privacy policy and terms of use of the website: https://www.newbalance.co.il/he/inst?q=privacy. The mere act of joining the club constitutes consent to the privacy policy and terms of use of the website, including the fact that the company and/or the group and/or any other brand that will be added to the group will be able to use the details provided and any information that will be accumulated in connection with the club member (including purchases made by him) and/or any data that will be produced based on the analysis of the data as aforesaid, and will be used by the company and/or the group to promote its activities, conduct information analysis and statistical research and for direct mailing to club members. It is clarified that the use of the aforementioned information will not be considered a violation of privacy and will not entitle the club member to any remedy and/or compensation whatsoever.
2.3    The responsibility for filling in and updating the details on the registration form lies with the club member and the company will not be responsible for any malfunctions and/or failure to receive benefits due to an error in the identification details and/or failure to fill in and/or fail to update the aforementioned details. The club member confirms that the details he/she will provide are correct, up-to-date and complete and that he/she will update the company about any changes to these details.
2.4    The company reserves the right to refuse and/or approve the registration of a customer as a club member, for any reason whatsoever and at its discretion.
2.5    Upon completion of the club registration, the club member will be added to the list of club members and will have the club membership benefit available to him/her for the following two months. It is clarified that any membership benefit that is not used by the end of the period specified above will be deleted.
2.6    Club membership is intended for private customers and for their personal use only. It is not intended for business purposes, and the points accumulated within it cannot be converted, transferred, or used by or through another person.


3.    Accumulation and redemption of points
3.1    Accumulation of points by a club member will begin on the day the club is launched. Accumulation and redemption of points are subject to the club member logging into the user account. Making purchases under "guest" status will not allow the accumulation of points.
3.2    Upon the launch of the club, registered customers will benefit from a joining benefit worth 50 NIS, which they must redeem within two months of the month in which they joined.
3.3    The club member will accumulate points for every transaction they make on the website and in the brand's stores in Israel, subject to changes and exceptions as decided by the company from time to time. Accumulation of points is based on the final amount for payment, excluding shipping fees. Accumulation of points will be possible when purchasing products on the website using credit cards, PayPal, or a MultiPass card. An update regarding the accumulation of points will be made after 72 hours from the date of the order. Retroactive accumulation of points will not be possible. The accumulation will constitute 5% of the total purchase on the New Balance website or the brand's stores. "Special" points may be accumulated at events and/or on products and/or on different brands and/or for specific customer groups, all at the sole discretion of the company, as may be the case from time to time.
3.4    The points are equivalent to a 1:1 ratio, so that the redemption of one point is equal to a discount of 1 NIS. When redeeming the points, no balance will be required in the club member's account. The balance of accumulated points can be checked on the website, in the personal area.
3.5    Points earned can be redeemed only within 12 months of the last purchase date, provided that the club member's membership is valid. If no purchase has been made on the site for a period exceeding 12 months, the points will be reset (deleted) and cannot be used. The deletion will be performed automatically without the company being obligated to notify the club members of the deletion and no claim will be heard in this regard. If a club member's membership expires, for any reason, the member will not be able to use the remaining points earned to his credit.
3.6    A gift given for a certain basket size in a purchase on the site will be directly affected by the use/non-use of points at the time of purchase.
3.7    During certain promotions on the company's brands and/or regarding market products and/or other products (as may be defined from time to time at the company's sole discretion), the company may limit the right of club members to redeem the points. In addition, it is not possible to pay for shipping fees by redeeming points.
3.8    A club member who has points will be required to redeem them before entering a coupon code in his possession. It is clarified that the company reserves the right to determine cases in which it will not be possible to redeem a coupon and/or benefit in addition to redeeming points, and the club member will be required to choose which benefit to redeem. In addition, there may be cases in which it will not be possible to redeem points and/or benefits on special sale dates. It is also clarified that a coupon code does not apply to selected brands as determined from time to time by the company.
3.9    In the event that it becomes apparent that, due to a malfunction or other defect, a club member was able to use points in excess of the amount accumulated to his credit as shown in the Company's systems, the Company will be entitled to demand that he covers the deficit.


4.    Nature of the benefits in NB Club
4.1    The accumulation of points and the benefits to which a club member is entitled will be as detailed below:

5.    Cancellation of Membership and Termination of Club Activity
5.1    A club member shall be entitled to withdraw from the club by giving written notice to the company, at service@silonsport.co.il. In such a case, the club member shall be removed from the list of club members within 3 business days from the date of receipt of the notice of his desire to withdraw as aforesaid, and all points and/or benefits accrued to him shall be cancelled, without him being entitled to any payment, benefit or compensation. He may rejoin the club by submitting a written request to the company, at service@silonsport.co.il.
5.2    The company shall be entitled to cancel the membership of a club member, for any reason whatsoever, without being obliged to justify the cancellation of his membership as aforesaid. A club member who violates the provisions of these regulations and/or the provisions of any law shall not be entitled to benefits and/or points under these regulations.
5.3    The company reserves the right to prohibit any action and/or realization of benefits and/or points in accordance with club membership, including provisions on suspension or termination of club membership, in cases of abuse and/or violation of the provisions of the regulations and/or any law. such cases, all points and/or benefits that have been accumulated will also be canceled and/or offset.
5.4    The company may announce in any way it deems appropriate the cessation of club activity with prior notice to be given in accordance with the provisions of the law, including the Consumer Protection Law, 5741-1981.


6.    Cancellations and Product Returns
6.1    Cancellation, return or exchange of products for which points were earned when purchased will result in the cancellation of the points earned in the transaction as aforesaid. If, between the date of purchase and the date of cancellation, return or exchange as aforesaid, the club member has redeemed points earned in the transaction as aforesaid, then upon cancellation of the transaction the club member will be charged a monetary amount equal to the number of points redeemed and cancelled. The company reserves the right to offset the monetary amount from other transactions of the club members.
6.2    Partial cancellation of a transaction will cause a deduction of the earned credit points. If credit points are used, then they will not be refunded to the client's account.
6.3    When canceling a full purchase, the amount that will be refunded to the customer will be the amount received after redeeming the points. The credit points earned will be deducted from the client's account. The credit points used in the transaction will be refunded to the client's account.


7.    Miscellaneous
7.1    Club membership is valid when used on the website or upon the presentation of a valid club member in the brand's stores. The benefits granted by club membership cannot be exercised in third-party stores where the company's brands are sold.
7.2    The company's internal records, regarding these regulations, will constitute conclusive evidence of the correctness of the above.
7.3    The company reserves the right to change and/or update and/or cancel the club's terms, as well as to grant additional and/or other benefits, including different points accumulation, to some club members, and to offer other promotions or benefits, at its discretion.
7.4    In any case it is proven that there is a legal reason for preventing a customer from joining the club or receiving any benefit, the compensation to which the customer will be entitled after proving his claim will be limited to the amount of the benefit granted within the club and not beyond that. Without derogating from the foregoing, it is clarified that, with the exception of the rights granted to the club member in accordance with the club plan as it may be from time to time, the club member releases Silon Sports Marketing Ltd. and/or anyone on their behalf from any claim and/or demand and/or claim directly or indirectly related to his membership in the club.
7.5    If a competent court determines that any of the terms of these regulations are invalid, or unenforceable by virtue of the provisions of the relevant laws, then this condition will be removed without affecting the validity of the remaining terms of these regulations.
7.6    The company reserves the right to add, change, revoke and replace the rules and procedures of the regulations at any time, without any prior notice and at its sole and absolute discretion. As of the date of the change of the regulations, only the new version will bind the club.
7.7    These regulations will be subject to the laws of the State of Israel only and the jurisdiction in all matters and matters related to these regulations and/or arising therefrom, is exclusively vested in the competent court in Tel Aviv-Yafo, while denying the jurisdiction of any other court.
7.8    The terms of these regulations shall apply in addition to the provisions of the regulations and privacy policy existing on the website. In any case of conflict between these regulations and the website regulations, the provisions of these regulations shall prevail.
